1. Acceptance of Terms

By accessing or using Office Pool Golf at officepoolgolf.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Office Pool Golf ("OPG") is an entertainment platform that allows users to create and participate in prediction pools for professional golf tournaments. Users select rosters of professional golfers and compete against others based on those golfers' actual tournament performance.

Entertainment purposes only. The Service is provided solely for entertainment and social competition among people who know each other. OPG is not a gambling service, betting platform, or daily fantasy sports operator. It is your responsibility to ensure your participation complies with the laws of your jurisdiction.

Platform only. OPG provides tools for pool creation, roster selection, scoring, and leaderboard tracking. OPG does not collect entry fees, hold funds, or distribute payouts. All financial arrangements are between pool commissioners and participants (see Section 5).

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and that your use of the Service does not violate any applicable law or regulation in your jurisdiction.

4. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it updated. You may not share your account or use another person's account without permission.

Usernames, pool names, entry names, and commissioner notes are subject to automated content filtering. Content that violates community standards (including profanity, slurs, or impersonation) may be rejected or result in account action.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used in an abusive, fraudulent, or harmful manner.

6. Tier System

Pools are created at one of four tier levels (Par, Birdie, Eagle, Albatross), each offering different feature sets and capacity limits. During the beta period, all tiers are available at no charge. Future pricing, if any, will be announced in advance. OPG reserves the right to modify tier features, limits, and pricing at any time.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law
• Create multiple accounts to gain an unfair advantage in pools or circumvent pool entry limits
• Attempt to access, tamper with, or disrupt the Service's servers, databases, or security features
• Scrape, copy, or redistribute any data from the Service without our written consent
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Post or transmit any content that is abusive, harassing, threatening, discriminatory, or fraudulent
• Attempt to reverse engineer any portion of the Service
• Use the Service to operate or promote commercial gambling or betting operations

8. Third-Party Data and Trademarks

The Service displays tournament results, player rankings, scoring data, and other golf-related information sourced from publicly available third-party sources for entertainment purposes. OPG does not claim ownership of this data and makes no warranties regarding its accuracy, completeness, or timeliness.

The following trademarks are the property of their respective owners and are used on this platform solely for identification purposes (nominative use). This list is representative and not exhaustive:

• PGA Championship is a trademark of the PGA of America
• U.S. Open is a trademark of the United States Golf Association (USGA)
• The Open Championship is a trademark of The R&A
• PGA Tour is a trademark of PGA Tour, Inc.
• ESPN is a trademark of ESPN, Inc.
• Official World Golf Ranking and OWGR are trademarks of OWGR Limited
• Slash Golf and Live Golf Data API are trademarks of their respective owners

All other tournament names, organization names, player names, likenesses, logos, and related marks referenced on this platform are trademarks or registered trademarks of their respective owners.

OfficePoolGolf is an independent platform and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with any professional golf tour, tournament, governing body, broadcaster, or any professional golfer. No endorsement or official connection is implied by the use of any third-party name or mark on this platform.

9. Intellectual Property

The Service and its original content, features, and functionality — including but not limited to text, graphics, logos, the "Office Pool Golf" name, the "The Game Within the Game" tagline, and software — are owned by Office Pool Golf and are protected by United States and international copyright, trademark, and other intellectual property laws.

User-generated content (pool names, entry names, commissioner notes, and other text you submit) remains your responsibility. By submitting content through the Service, you grant Office Pool Golf a limited, non-exclusive, royalty-free license to display and use that content solely to operate the Service.

10. Beta Disclaimer

The Service is currently in beta. Features, functionality, tier limits, and pricing may change at any time without prior notice. While we strive to maintain reliable service, we do not guarantee uninterrupted availability or preservation of data beyond the retention periods stated in our Privacy Policy.

By using the Service during the beta period, you acknowledge and accept these conditions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TOURNAMENT SCORES, PLAYER RANKINGS, AND OTHER GOLF DATA DISPLAYED ON THE SERVICE ARE SOURCED FROM THIRD PARTIES AND ARE PROVIDED FOR ENTERTAINMENT PURPOSES ONLY. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THIS DATA.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFICE POOL GOLF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, OR DISPUTES BETWEEN POOL COMMISSIONERS AND PARTICIPANTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OPG IS A PLATFORM ONLY AND IS NOT RESPONSIBLE FOR ANY FINANCIAL DISPUTES, LOSSES, OR DISAGREEMENTS BETWEEN POOL COMMISSIONERS AND PARTICIPANTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Office Pool Golf and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, any financial arrangements you make with other users in connection with pools, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including but not limited to violations of these Terms, content policy violations, fraudulent activity, or creation of multiple accounts. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 8, 9, 11, 12, and 13.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
